BREXIT UPDATE:

After Brexit, sourcing products from the UK may not be possible or may be restricted due to customs, compliance, logistics and import issues. All products imported and sold by Maltazon, including Maltazon Now and Maltazon Quick products, are normally sourced from Europe. Therefore:

- Products will be supplied only and exclusively with a European plug, where applicable, such as Type C or Type F Schuko. No UK adapter will be provided by Maltazon unless expressly stated in the product description.

- Products will be supplied, where applicable, with a European keyboard layout, which may include Italian or other European layouts depending on supplier availability. No UK keyboard will be provided by Maltazon unless expressly stated in the product description.

By placing an order, the Buyer accepts the effects of Brexit, the product sourcing conditions described above, and these Terms and Conditions. No refund request may be made solely on the basis that a product is supplied with a European plug or European keyboard layout where this has been disclosed in these Terms and Conditions or in the product description.

4. SHIPMENTS

General conditions of shipments

Items sold on Maltazon.com can only be shipped to Malta and Gozo, unless otherwise expressly agreed in writing.

• Orders placed on Maltazon.com containing Maltazon Now and Maltazon Quick products are sent by express courier to the delivery address indicated by the user during the order. For shipments of Maltazon Now and Maltazon Quick products, we use different couriers, chosen according to the coverage of the territory and the services offered. At the time of the order, our logistics system will identify the most suitable courier in terms of service and geographical delivery area. For this reason, it is not normally possible to choose the preferred courier at the time of order. As soon as the order is shipped, the system will send an email to the email address provided by the customer to communicate the departure of the shipment.

• Orders placed on Maltazon.com containing products sold by Sellers will be handled according to the shipping policy dictated by the Sellers, where applicable.

4.2 Delivery time

The delivery time depends on the destination and the type of product purchased. Delivery times may vary due to force majeure, recipient absence, courier delays, traffic restrictions, weather events, supplier delays, customs delays, public holidays, stock availability or other circumstances beyond Malta System LTD’s reasonable control.

• The delivery time of Maltazon Now products is normally 24/48 hours for Malta and 72 hours for Gozo.
• The delivery time of Maltazon Quick products is normally within 12 working days for Malta and within 15 working days for Gozo, unless otherwise indicated. Working days exclude Saturday, Sunday and public holidays.

• Items on Maltazon.com sold by Sellers will be handled according to the shipping schedule dictated by the Sellers, where applicable.

4.3 Shipping costs

• The delivery costs of Maltazon Now and Maltazon Quick products are borne by the Buyer, unless free shipping applies. The standard transport cost is €4.90 for Malta and €8.90 for Gozo, unless otherwise indicated at checkout.

• The delivery costs of Maltazon Now and Maltazon Quick products are free if the cart amount is equal to or greater than €50 in Malta and equal to or greater than €100 in Gozo, unless otherwise indicated at checkout or in a specific promotion.

• The delivery costs of Sellers’ products on Maltazon.com are borne by the Buyer and will be managed according to the cost policy dictated by the Sellers, where applicable. Before purchasing any Sellers’ product on Maltazon.com, the Buyer should check the applicable shipping conditions, costs and return conditions. The applicable shipping costs are shown at checkout in the order summary.

4.4 Shipping procedures

Within the customer area, the status of the order is indicated. As soon as the shipment is entrusted to the courier, the order status will be updated to “Shipped”. As soon as the courier confirms delivery, the order status may be updated to “Delivered”.

The courier in charge of the delivery may notify the customer by telephone before making the delivery, using the number indicated by the customer at the time of purchase. The phone call made by the courier cannot be considered or managed as delivery by appointment. The phone call made by the courier is to be considered a delivery notice. If the customer does not confirm availability for delivery or does not respond to any phone calls made during the day, the courier may not be required to make a delivery attempt. If a telephone contact cannot be established within three days of the shipment, the customer may be required to collect the product at our pickup point and the shipping costs may not be refunded as they are necessary to cover courier costs.

4.5 Protection of customer’s rights

At the time of delivery of the goods by the courier, the customer is invited to carry out normal checks for the protection of his or her rights: that the packaging is intact, not damaged, wet or otherwise altered, including the closing materials such as tape, straps or seals.

If any damage to the packaging and/or the product is noticed, or if the number of packages does not match, the customer must immediately report this at the time of delivery to the courier. The customer should sign with a written and specific reservation, describing the type of damage found on the courier’s proof of delivery.

Once the courier document has been signed without any specific written reservation, the customer may not be able to raise a claim regarding the external characteristics of what was delivered, without prejudice to any mandatory rights that cannot be excluded under applicable law.

If the packaging is apparently intact and, after opening, the customer finds defects or damage, the customer is required to keep the original packaging in order to allow Malta System LTD to open a hidden damage claim with the courier where applicable. The relevant communication must be made within 48 hours from receipt of the goods through the appropriate “Contact us” section on Maltazon.com.

We invite the customer not to throw away the original packaging where there is damage to the product. The customer may be asked for photos of the original box and all its components. Claims for products without original packaging may not be accepted where the original packaging is necessary to verify transport damage, supplier inspection or manufacturer inspection, without prejudice to any mandatory consumer rights that cannot be excluded under applicable law.

5. MALTAZON PICKUP POINT

The Maltazon Pickup Point allows Maltazon customers to collect, in a different way from classic courier delivery, the products purchased on Maltazon.com.

There are no strict time limits to the collection of purchased goods, unless otherwise communicated. However, Malta System LTD reserves the right to contact the customer and request collection within a reasonable time where goods remain uncollected for an extended period.

6. WARRANTY & RMA

6.1 Legal Guarantee for Consumer Purchases

All new products sold by Malta System LTD / Maltazon to consumers are covered by the legal guarantee of conformity provided under applicable Maltese and European consumer protection law.

For the purpose of these Terms and Conditions, a consumer means a natural person who purchases goods for purposes which are outside his or her trade, business, craft or profession.

For consumer purchases, the legal guarantee applies for 24 months from the date of delivery of the goods, subject to the conditions, limitations and remedies provided under applicable law.

For reconditioned, refurbished, used or second-hand products, the warranty period may be limited to 12 months where permitted by applicable law and where clearly stated at the time of purchase.

The legal guarantee applies only where the lack of conformity existed at the time of delivery or is otherwise covered by applicable consumer law. Damage caused by misuse, accidental damage, incorrect installation, external causes, unauthorised repair, tampering, normal wear and tear, lack of maintenance, software issues, viruses, malware, power surges, liquid damage, humidity, transport damage or use outside the manufacturer’s specifications is excluded, unless otherwise required by mandatory applicable law.

Malta System LTD is only liable for products sold directly by Malta System LTD / Maltazon. Products sold by third-party sellers on Maltazon.com, where applicable, are subject to the warranty and after-sales conditions of the respective seller, without prejudice to any mandatory consumer rights that may apply.

6.2 Business / B2B Purchases

Purchases made by companies, businesses, professionals, self-employed persons, public entities, schools, hospitals, offices, institutions, organisations, or any customer purchasing with company details, VAT number, business details, or requesting a tax invoice for business purposes, are considered Business-to-Business (B2B) purchases.

For B2B purchases, the consumer legal guarantee framework does not apply in the same way as it applies to private consumer purchases. B2B purchases are governed by these Terms and Conditions, the invoice terms, any written agreement between the parties, and applicable commercial law.

Unless otherwise expressly agreed in writing by Malta System LTD, B2B purchases are covered by a limited commercial warranty of 12 months starting from the original invoice date.

After the expiry of the 12-month B2B warranty period, Malta System LTD is not obliged to provide free repair, replacement, credit note, refund, or warranty RMA. Any assistance after expiry of the applicable warranty period may be offered only as a paid diagnostic, paid repair, paid replacement quotation, or paid service intervention.

6.3 Original Invoice Date, Delivery Date and Previous Repairs or Replacements

For consumer purchases, the legal guarantee period starts from the date of delivery of the original goods, subject to applicable law.

For B2B purchases, the limited commercial warranty period starts from the original invoice date, unless otherwise expressly agreed in writing by Malta System LTD.

Any repair, replacement, service intervention, RMA intervention, reset, exchange, goodwill replacement, manufacturer intervention, supplier intervention, or replacement of a product, spare part, component or accessory does not restart, renew, extend, or create a new warranty period, unless Malta System LTD expressly confirms a separate warranty extension in writing.

Any replaced product, repaired product, spare part, component, accessory, or exchanged unit remains covered only for the remaining period of the original applicable warranty, subject to any mandatory consumer protection rules that cannot be excluded under applicable law.

For the avoidance of doubt, a replacement or previous warranty intervention does not create a new purchase date and does not create a new warranty period starting from the date of replacement.

6.4 Manufacturer’s Commercial Warranty

Some products may also be covered by a manufacturer’s commercial warranty. The duration, territorial scope, conditions, exclusions and procedure of the manufacturer’s commercial warranty are determined exclusively by the manufacturer.

A manufacturer’s commercial warranty is separate from, and does not replace or reduce, any mandatory legal guarantee available to consumers under applicable law.

Where the manufacturer provides direct warranty support, the customer may be required to contact the manufacturer or the authorised service centre directly. Malta System LTD may assist the customer where reasonably possible, but remains bound by the manufacturer’s warranty procedure, terms, limitations and conditions.

6.5 RMA Procedure

An RMA may be opened only where the product is still within the applicable warranty period and where the reported issue is potentially covered by warranty.

Malta System LTD reserves the right to request proof of purchase, invoice, delivery confirmation, serial number, product photos, videos, diagnostic evidence, manufacturer report, supplier report, original packaging, accessories and any other information reasonably required to assess the warranty claim.

The customer must not send or deliver any product without prior RMA authorisation. Products received without an approved RMA number may be refused or returned at the customer’s expense.

Once an RMA is approved, the customer must deliver or ship the product to Malta System LTD within 14 working days, unless otherwise agreed in writing. If the product is not received within this period, the RMA request may be cancelled and a new request may be required.

The customer must send or deliver the goods to Malta System LTD, Mriehel Business HUB, MBH - Office 2, Level 1, Triq L-Arkata L-Baxxa, Central Business District, Zone 3 Mriehel, Birkirkara, CBD3110, Malta, unless otherwise instructed in writing.

Repair or inspection times may vary depending on the product, supplier, manufacturer, availability of spare parts, diagnostic complexity and service centre procedures.

If the product is repaired or replaced under warranty, the product will be made available for collection at Malta System LTD’s premises. If the customer requests delivery or shipment, shipping costs may be charged to the customer where permitted by law or where the claim is not covered by warranty.

If, after inspection, the issue is found not to be covered by warranty, Malta System LTD may offer a paid repair quotation. If the quotation is refused, the product may be returned unrepaired, and diagnostic, handling, storage or shipping charges may apply.

6.6 Warranty Exclusions

The warranty does not cover:

  • accidental damage;
  • misuse, abuse, negligence or improper handling;
  • damage caused by incorrect installation, configuration, maintenance or calibration;
  • damage caused by use outside the manufacturer’s specifications or product documentation;
  • normal wear and tear;
  • consumables, batteries, print heads, toners, cartridges, cables, accessories or parts subject to normal deterioration, unless otherwise required by law;
  • software issues, viruses, malware, corrupted operating systems, corrupted firmware, third-party software conflicts or data loss;
  • unauthorised repair, modification, opening, tampering or technical intervention not carried out or authorised by Malta System LTD or by an authorised service centre;
  • removed, altered, damaged or unreadable serial numbers, seals, labels, service tags or identification labels;
  • damage caused by transport, inadequate packaging, humidity, liquid, fire, power surges, electrical faults, incorrect voltage, unsuitable power supply or other external causes;
  • damage caused by lack of maintenance, incorrect maintenance, inadequate cleaning or unsuitable operating environment;
  • products returned without original packaging where such packaging is required for safe transport or manufacturer/supplier inspection;
  • products returned without accessories, manuals, cables, power supplies, adapters, components or other items originally supplied, where these are necessary for warranty inspection or service processing.

Malta System LTD is not responsible for loss of data, software, programs, settings, removable media or confidential information stored on products submitted for repair, inspection or replacement.

The customer is responsible for backing up and removing all data, passwords, accounts, personal information, confidential information and removable media before submitting any product for assistance. Products may be reset, formatted, repaired, replaced or restored to factory settings during the service process.

6.7 Paid Diagnostics and Repairs Outside Warranty

Where a product is outside the applicable warranty period, or where the issue is excluded from warranty, Malta System LTD may offer a paid diagnostic and/or repair quotation.

No repair will be carried out without the customer’s prior approval of the quotation, unless otherwise agreed in writing.

If the customer refuses the quotation or does not reply within a reasonable time, Malta System LTD may return the product unrepaired and may charge diagnostic, handling, storage or shipping fees where applicable.

6.8 Legal References

These warranty terms are based on the distinction between consumer purchases and business-to-business purchases under applicable Maltese and European consumer protection rules, including:

For the avoidance of doubt, nothing in these Terms and Conditions is intended to exclude, restrict or limit any mandatory rights that cannot be excluded, restricted or limited under applicable Maltese or European law.

7. THE RIGHT OF WITHDRAWAL

Maltazon.com recognises the consumer’s right of withdrawal where applicable under Maltese and European consumer protection law.

The right of withdrawal applies only to consumers, meaning natural persons who purchase goods for purposes which are outside their trade, business, craft or profession.

The right of withdrawal does not apply to professionals, companies, businesses, self-employed persons, public entities, schools, hospitals, offices, institutions, organisations, or any customer purchasing with company details, VAT number, business details, or requesting a tax invoice for business purposes, as such purchases are considered Business-to-Business (B2B) purchases.

7.1 Conditions for the applicability of the right of withdrawal

For eligible consumer distance purchases, the consumer may withdraw from the purchase contract without giving any reason within 14 calendar days from the day on which the consumer, or a third party other than the carrier and indicated by the consumer, acquires physical possession of the goods.

Where an order is delivered in multiple lots or pieces, the withdrawal period starts from the day on which the consumer, or a third party other than the carrier and indicated by the consumer, acquires physical possession of the last good, lot or piece.

The right of withdrawal applies to eligible consumer purchases unless a legal exception applies.

The right of withdrawal may not apply, among other cases, to:

  • goods made to the consumer’s specifications or clearly personalised;
  • goods which are liable to deteriorate or expire rapidly;
  • sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
  • sealed audio or video recordings or sealed computer software which were unsealed after delivery;
  • digital content not supplied on a tangible medium, where performance has begun with the consumer’s prior express consent and acknowledgement that the right of withdrawal may be lost;
  • goods which, after delivery, are inseparably mixed with other items;
  • services fully performed with the consumer’s prior express consent and acknowledgement that the right of withdrawal may be lost once the service has been fully performed;
  • any other case where the right of withdrawal is excluded or limited by applicable law.

Maltazon Quick products are not automatically excluded from the right of withdrawal solely because they are imported from a supplier. However, where a Maltazon Quick product is specifically ordered, configured, customised, personalised, sourced or imported according to the consumer’s specific request and falls within one of the legal exceptions to the right of withdrawal, the right of withdrawal may be excluded where permitted by law and where this has been clearly communicated to the consumer before purchase.

For all Sellers’ products, where applicable, the right of withdrawal will be managed according to the withdrawal policies dictated by the Sellers, without prejudice to any mandatory consumer rights that may apply.

In general, no return of items will be permitted without the prior written consent or authorisation of Maltazon.com, except where the consumer is exercising a mandatory right of withdrawal or other mandatory consumer right under applicable law.

In addition:

• the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased, such as accessories, software attachments or components, unless otherwise agreed or required by law;
• the right may not apply, following opening or breach of factory seal, to audiovisual products, consumables, sealed computer software, sealed products not suitable for return for health or hygiene reasons, products subject to personalisation, products made to the customer’s specifications, or other products excluded by law;
• the purchased goods must be returned intact, complete, not damaged, not tampered with and, where reasonably possible, in the original packaging, complete in all parts, including manuals, cables, accessories, documentation and protective materials.

The goods subject to withdrawal must be returned in a normal state of conservation and must have been handled only as necessary to establish their nature, characteristics and functioning. Products showing damage, dirt, excessive wear, missing parts, misuse, tampering or handling beyond what is necessary to establish their nature, characteristics and functioning may be subject to a deduction from the refund to reflect the diminished value of the goods, where permitted by law.

7.2 Shipping costs in case of withdrawal

The direct shipping costs related to the return of the goods, upon acceptance of the right of withdrawal, are charged to the Customer unless otherwise required by law or expressly agreed in writing by Malta System LTD.

The shipment, until confirmation of receipt at the Maltazon.com head office, is under the full responsibility of the customer. In case of damage to the goods during transport, Maltazon.com will inform the customer of the event within a reasonable time from receipt of the goods, in order to allow the customer to lodge a timely complaint with the courier chosen by the customer and obtain reimbursement of the value of the goods, if insured. In this case, the product may be made available to the customer for return and the withdrawal request may be suspended or cancelled where permitted by law.

7.3 Limitation of the right of withdrawal

The right of withdrawal does not apply to Business-to-Business (B2B) purchases. This includes purchases made by professionals, companies, businesses, self-employed persons, public entities, schools, hospitals, offices, institutions, organisations, or any customer purchasing with company details, VAT number, business details, or requesting a tax invoice for business purposes.

Nothing in this section is intended to exclude, restrict or limit any mandatory consumer right that cannot be excluded, restricted or limited under applicable law.

7.4 How to make the request

Within 14 calendar days calculated from the delivery of the goods, the consumer must inform Maltazon.com that he or she wants to exercise the right of withdrawal through the appropriate “Contact us” form on Maltazon.com or by sending a clear written statement by email to info@maltazon.com.

The consumer must clearly identify the order number, product, name, surname, contact details and intention to withdraw from the purchase contract.

After the withdrawal request is received, Maltazon.com will provide instructions for the return of the goods, where applicable.

7.5 Refund time

Once the withdrawal request has been accepted and the goods have been received and verified, Maltazon.com will refund the amount paid by the consumer for the returned product, subject to any lawful deductions for diminished value, missing accessories, damage, excessive handling, shipping costs or other amounts permitted by law.

Refunds will normally be made using the same payment method used by the consumer for the original transaction, unless otherwise agreed. Malta System LTD may withhold the refund until it has received the goods back or until the consumer has supplied evidence of having sent back the goods, whichever occurs first, where permitted by law.

Any refund shall be processed within the timeframe required by applicable law, once the applicable conditions are satisfied.

7.6 Legal References for Withdrawal Rights

The withdrawal rights described in this section are based on applicable Maltese and European consumer protection rules, including:

For the avoidance of doubt, nothing in these Terms and Conditions is intended to exclude, restrict or limit any mandatory rights that cannot be excluded, restricted or limited under applicable Maltese or European law.
